PLEASE GATHER THE FOLLOWING ITEMS:

 

  • 1. I need to review your bills. Bring in the actual bills received from your creditors over the last 90 days if you have them. I will get a credit report for you as well. It may or may not list all of your debt so gather as many bills as possible.
  • 2. I need to show the court proof of your income (including child support) over the last six months. Payroll stubs will work. If you work for yourself, bring in your bank deposits. Or you may have to get a letter from your payroll department.
  • 3. If you own a home, I need to review your closing papers. Your closing papers will have a deed, a deed of trust, note, appraisals etc.
  • 4. I need to review the Income tax form you filed for last year.
  • 5. I need to review any court documents you may have received over the last year. These include lawsuits, judgments, liens, divorce papers, child support orders.
  • 6. I may need to review you checking account statements for the last 12 months.
  • 7. You must have car and home insurance. Be prepared to purchase insurance if your policy has lapsed. Let me know if you don’t have current insurance.
  • 8. I need to know if anyone has co-signed a debt for you such as your mom, dad, former wife or husband, best friend etc.

 

WHAT DOES IT COST? Our attorney fee for a Chapter 7 petition starts at $800 and increases depending upon the complexity of your case. I require an attorney fee deposit of $300 when you file a chapter 13 bankruptcy. Most of a Chapter 13 bankruptcy attorney fee is paid through your repayment plan. Emergency Chapter 13 petitions require a higher deposit.

OTHER FEES: The United States Bankruptcy Court requires a Chapter 7 filing fee of $299 to be paid within 60 days of filing you petition; and $274 for a Chapter 13 filing fee paid through your repayment plan. A $50 briefing fee paid to a consumer credit service is required before you file any bankruptcy. In Chapter 7, after your hearing, you must attend an education class within 45 days which costs $50 as well. This education class is free when you file a Chapter 13. Revised: 03/12/2008
